United States Supreme Court rules that Lexmarks prebate Cartridges can be refilled.
The Judge ruled that when Lexmark sells its prebate cartridges, it exhausts its patents, and cannot use those patent rights to prevent anyone from remanufacturing that cartridge.
The United States Supreme Court considered related issues last summer in a case known as Quanta Computers v. LG Electronics.
The court in Quanta ruled that when a company makes an authorized sale, then its patent rights in the sold product are exhausted, and cannot be asserted against anyone else who buys or uses that product.
